GENERAL TERMS AND CONDITIONS FOR CLEANING WORK

1. General
Widtmann Services e.U. accepts orders and commissions from customers (clients) only on the basis of the following General Terms and Conditions. Orders and commissions thereby become contracts. Supplementary and/or deviating provisions or conflicting terms and conditions require the express and legally valid signed consent of Widtmann Services e.U.

2. Scope of Services of Widtmann Services e.U.
The scope of contractual services and the fees are determined by a separate agreement to be concluded between Widtmann Services e.U. and the customer, such as an offer, appointment confirmation, confirmation email, or telephone order. Any supplementary agreements or modifications that alter the scope of the originally agreed contractual services and/or the price require an express agreement between Widtmann Services e.U. and the customer and must be in writing.

2.1 Telephone agreements are also considered a contract between the customer and Widtmann Services e.U. In this case, Widtmann Services e.U. will prepare a call log and, as a rule, send the customer an order and appointment confirmation by email. If the on-site service deviates from the agreed conditions (e.g., scope of service), Widtmann Services e.U. will inform the customer on-site and adjust the service costs on the invoice accordingly.

2.2 Terms and Conditions Cancellation of Commissioned Services by the Customer
Cancellation by the customer of a binding service appointment (including those agreed upon by telephone) must be made in writing via the contact form (Subject: Cancellation) or to the email address: office@matratzenreinigung.biz with the relevant information (the timestamp of the cancellation email is decisive). Cancellations made by telephone are not legally valid! If the customer does not cancel in accordance with this agreement, or if the customer cancels due to the criteria listed below, cancellation fees may apply:

  • Cancellation by the customer up to 48 hours before the agreed service appointment is free of charge.
  • Cancellation by the customer from 47 hours to 24 hours before the agreed appointment: Widtmann Services e.U. will charge 50% of the agreed order amount.
  • Cancellation by the customer less than 24 hours before the agreed appointment: Widtmann Services e.U.
  • If the Widtmann Services e.U. team does not find a contact person on site at the agreed time, 100% of the agreed order amount will be charged.

2.3 Cancellation of Service Appointments by Widtmann Services e.U.
Due to unforeseen circumstances (employee illness, exceptional traffic conditions, force majeure, etc.), Widtmann Services e.U. may be unable to keep the scheduled service appointment late or at all. In such cases, Widtmann Services e.U. will generally inform the customer by telephone and, if necessary, arrange an alternative appointment. The customer has no rights to any claims whatsoever (compensation for costs, time spent by the customer, personnel costs, etc.) due to a cancellation of service appointments by Widtmann Services e.U.

2.4 Invoices: Widtmann Services e.U. will generally bring the corresponding invoice to the cleaning appointment. If the service provided on-site deviates from the agreed-upon terms (scope of service, stain removal, etc.), Widtmann Services e.U. Inform the customer on site, adjust the service costs accordingly in the invoice and send it to the customer by email/post.

3. Cleaning Disclaimer
Despite the utmost care taken during cleaning, in rare exceptional cases damage (e.g., fraying, tears, etc.) and/or staining may occur on the items being cleaned. In such cases, Widtmann Services e.U. cannot accept any liability for this damage. Widtmann Services e.U. also cannot offer any warranty or guarantee on its services. Complaints not raised immediately after cleaning cannot be considered.

3.1 Disclaimer Regarding Stain Treatments
Widtmann Services e.U. may use a steam cleaner and, where possible, a stain remover that is gentle on materials. Unlike dry cleaning, steam-cleaned items generally cannot be used immediately after cleaning, as they must be allowed to dry completely. In rare cases, steam cleaning may cause water spots on the items being cleaned, but these are completely harmless. We may use special cleaning fluids (e.g., enzyme cleaners) to remove stains from mattresses or textiles. After treatment, light or dark spots may appear on the surfaces, and in particular, color fading or discoloration may occur.
In all of the above cases, Widtmann Services e.U. cannot accept liability for any stains, damage, or discoloration that may result from stain treatment. Widtmann Services e.U. also cannot guarantee the complete removal of stains or soiling of any kind. The customer fully indemnifies Widtmann Services e.U. against all claims that may have arisen from incomplete or unsatisfactory stain removal.

3.2 Disclaimer for Odor Removal
If the customer commissions Widtmann Services e.U. to treat odors caused by soiling of mattresses, upholstered furniture, or carpets with, for example, bodily fluids or pet excrement (e.g., cat urine), Widtmann Services e.U. will treat these odors to the best of its ability using special cleaning methods, solvents, and odor eliminators. In all of the aforementioned cases, Widtmann Services e.U. cannot assume any liability for stains or discoloration that may occur as a result of the odor removal. Furthermore, Widtmann Services e.U. cannot guarantee the complete removal of all types of odors. The customer fully indemnifies Widtmann Services e.U. against all claims that may arise from incomplete or unsatisfactory odor removal.

3.3 Disclaimer POTEMA Clean Spray® and Febreze Fabric Refresher
Upon request, the cleaned items can be treated with POTEMA Clean Spray® (ingredients: 95% 2-propanol, essential oils) or a fabric refresher (ingredients: benzisothiazolinone, fragrances, linalool). POTEMA Clean Spray® is manufactured by POTEMA GmbH, Schützenstr. 5, 98527 Suhl, Germany, and has a disinfectant effect. Before using POTEMA Clean Spray® or the fabric refresher, Widtmann Services e.U. will inform the customer about the effectiveness and ingredients by means of an information leaflet and obtain the customer's consent for use. In rare exceptional cases, people or animals may react sensitively to the fragrance or active ingredients of POTEMA Clean Spray® or the fabric refresher and/or experience discomfort (allergies, irritations, etc.). If the customer agrees to the use of POTEMA Clean Spray® or the fabric refresher, Widtmann Services e.U. cannot accept any liability for complaints of any kind or agree to any reimbursement of costs of amounts invoiced by Widtmann Services e.U.

3.4 Disclaimer of Liability for Damage During Cleaning
Despite the utmost care taken during cleaning, unintentional damage (e.g., from turning mattresses) to the customer's furnishings (e.g., lamps) or furniture may occur. In this case, Widtmann Services e.U. cannot accept any liability for damage or consequential costs of any kind.

3.5 Disclaimer of Liability for Off-Site Carpet Cleaning
Despite the utmost care taken during cleaning, off-site carpet cleaning and washing may cause damage, such as color bleeding, fraying, discoloration, or the development of odors. In this case, Widtmann Services e.U. cannot accept any liability for damage or consequential costs of any kind.

4. Prices & Payment Terms
Payment terms: Cash or EC/credit card after service against invoice, or bank transfer within the period specified on the invoice, without deduction of any discounts, etc. In case of late payment: 12.58% default interest per annum applies as the agreed rate. Furthermore, the customer is obligated to reimburse all costs of reminders for outstanding receivables (€40 reminder fee per reminder) as well as the costs of appropriate legal action (collection agency KSV 1870, lawyer, court costs).

5. Jurisdiction
The place of jurisdiction is Vienna.
